1. Agreement to these Terms
These Terms of Service ("Terms") govern your access to and use of the MindFit Academy website, programs, and services (collectively, the "Services"). The Services are provided by AEA Institute ("AEA," "we," "us," or "our") in partnership with Dr. Melissa Reed and Ryan Reed, operating as getKlarity.
By accessing the Site, creating an account, or purchasing a program, you agree to these Terms. If you do not agree, please do not use the Services.
2. Who may use the Services
You must be at least 18 years old, or the age of legal majority where you live, to purchase a program or create an account. By using the Services, you confirm that you meet this requirement and that the information you provide is accurate.
3. The Services are educational, not medical
MindFit Academy provides mental-fitness, performance, and wellness education. The Services are not medical or psychological treatment, diagnosis, or therapy, and are not a substitute for professional care from a licensed physician, therapist, or other qualified provider.
Nothing in the Services creates a doctor-patient, therapist-client, or other professional treatment relationship. You are responsible for your own health decisions, and you should consult a qualified professional before making changes that could affect your physical or mental health.
If you are experiencing a mental-health crisis, call or text 988 (Suicide & Crisis Lifeline) or seek emergency help.
4. Accounts
When you create an account, you are responsible for keeping your login credentials secure and for all activity that happens under your account. Notify us promptly at clientsuccess@aea-neuro-fitness-academy.com if you believe your account has been accessed without your permission.
5. Purchases, billing, and subscriptions
Pricing. Prices for programs are shown at checkout. We may change prices at any time, but changes will not affect purchases you have already made.
One-time purchases. Some programs are sold as a single payment that grants you access as described at checkout.
Subscriptions. Some programs are sold on a recurring (for example, monthly or annual) basis. By purchasing a subscription, you authorize us and our payment processor to charge your payment method on a recurring basis until you cancel. You can cancel a subscription at any time through your account or by contacting us; cancellation stops future charges but does not retroactively refund charges already made, except as described in Section 6.
Payment processing. Payments are handled by our third-party processor (Kajabi and its payment partners). By purchasing, you also agree to any applicable terms of that processor.
6. Refunds
We want you to be satisfied with your purchase. If you are not satisfied, you may request a refund within 14 days of your purchase by contacting us at clientsuccess@aea-neuro-fitness-academy.com. Refunds are issued at our discretion and may be subject to conditions described at checkout. Subscription renewals and certain promotional or discounted purchases may be non-refundable where stated at the time of purchase.
7. License and acceptable use
We grant you a personal, non-transferable, non-exclusive license to access the programs you purchase for your own personal, non-commercial use. You may not:
- share, resell, sublicense, or distribute program content to others;
- copy, reproduce, or republish content except as expressly allowed;
- use the Services for any unlawful purpose; or
- attempt to interfere with, disrupt, or gain unauthorized access to the Services or related systems.
8. Intellectual property
All content provided through the Services — including text, videos, audio, graphics, course materials, logos, and the MindFit Academy and AEA Institute brands — is owned by AEA, our partner, or our licensors, and is protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
9. User-submitted content
If you submit comments, questions, or other content through the Services, you grant us a non-exclusive, royalty-free license to use that content in connection with operating and improving the Services. You are responsible for the content you submit and confirm you have the right to share it.
10. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, or that any particular result, outcome, or level of improvement will be achieved. Results from any mental-fitness or wellness program vary from person to person and depend on individual effort and circumstances.
11. Limitation of liability
To the fullest extent permitted by law, AEA Institute, getKlarity, Dr. Melissa Reed, Ryan Reed, and their respective owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Services.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Services will not exceed the amount you paid us for the program giving rise to the claim in the 12 months before the claim arose.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless AEA Institute, getKlarity, and their owners, employees, and partners from any claims, damages, or expenses (including reasonable legal fees) arising out of your misuse of the Services or your violation of these Terms.
13. Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms or misuse the Services. You may stop using the Services at any time. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and governing law) will survive.
14. Governing law
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or related to these Terms or the Services will be resolved in the state or federal courts located in Hamilton County, Indiana, and you consent to the jurisdiction of those courts.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after an update means you accept the revised Terms.
